Consignment Agreement

Please read below contract. Be sure to check every box sectioned to agree to the terms of this contract.
GENERAL: Merchandise will be priced and selected at Swanky Babies discretion. Upon the sale of a consigned item, the Consignor will receive 40% of the final sales price, less tax. Swanky Babies reserves the right to price and discount all items accordingly. Swanky Babies does not guarantee your items will sell whether expressed or implied. Swanky Babies reserves the right to amend the contract agreement at any time. The contract shall be governed by & enforced in accordance with the laws of the State of Washington.

PAYMENT: Swanky Babiess store credit is always available immediately upon the sale of your merchandise. You will be given an online code to use your credit online. Checks are generated monthly upon request & you can request a check anytime with a $20 minimum. Checks are processed the 15th of the month and can be picked up or mailed. Venmo & Paypal may also be used to transfer payment. There is a $1 fee deducted from your account per payment issued. Account balances not redeemed within 6 months of activity are forfeited. I understand this policy.

AUTHENTICITY: Consignor attests to the authenticity of all consigned items & has not knowingly or otherwise requested the resale of counterfeit goods. Consignor also owns consigned items free and clear of any debts or payments.

LIABILITY: Consignor represents and warrants that he/she is at least 18 years old, the sole owner of the item(s) on consignment and the items are free of lien or other claims & saleable. We will do our best to protect your consignment, however all items are left in the possession of Swanky Babies at your own risk. Swanky Babies is not responsible for any loss or damage to items including damage caused by theft, fire, vandalism, natural disaster or any other unforeseen circumstances. If the Consignor wants to be protected against such potential loses, it is their responsibility to do so through their homeowner, renter or property insurance polices.

LIABILITY: Consignor represents and warrants that he/she is at least 18 years old, the sole owner of the item(s) on consignment and the items are free of lien or other claims & saleable. We will do our best to protect your consignment, however all items are left in the possession of Swanky Babies at your own risk. Swanky Babies is not responsible for any loss or damage to items including damage caused by theft, fire, vandalism, natural disaster or any other unforeseen circumstances. If the Consignor wants to be protected against such potential loses, it is their responsibility to do so through their homeowner, renter or property insurance polices. I understand and agree to this policy
Exclusivity:: By consigning my items with Swanky babies I understand that I am not to offer these items for sale on any other platform, market place or listing. Swanky Babies shall retain the exclusive right to sell the items i bring in for the agreed upon consignment period. Should I sell items on my own while under contract with Swanky Babies I Understand there may be a cleaning fee, contract termination fee, or listing fee that I must pay before I am able to pick up my items. Min cleaning fee of $50 for strollers, and a minimum fee of 15% of the listed sale price for other items may be applied.

Exclusivity:: By consigning my items with Swanky babies I understand that I am not to offer these items for sale on any other platform, market place or listing. Swanky Babies shall retain the exclusive right to sell the items i bring in for the agreed upon consignment period. Should I sell items on my own while under contract with Swanky Babies I Understand there may be a cleaning fee, contract termination fee, or listing fee that I must pay before I am able to pick up my items. Min cleaning fee of $50 for strollers, and a minimum fee of 15% of the listed sale price for other items may be applied. I agree to the terms above and to remove all personal listings I may have for my items
Item Abandonment: Consigned items left longer than 7 days after your 60 day period will be considered abandoned and become property of Swanky Babies. It is YOUR responsibility to reach out 5-7 days before the end of your consignment period to arrange pickup. Due to the amount of consignors we are unable to reach out to everyone individually. It is YOUR responsibility to do so.

Item Abandonment: Consigned items left longer than 7 days after your 60 day period will be considered abandoned and become property of Swanky Babies. It is YOUR responsibility to reach out 5-7 days before the end of your consignment period to arrange pickup. Due to the amount of consignors we are unable to reach out to everyone individually. It is YOUR responsibility to do so. I understand and agree to this policy. I understand I must reach out to arrange pickup of my items 5-7 days before the end of this consignment period.
